By accessing or using Ahoj Metrics ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Ahoj Metrics provides web performance monitoring and analysis services using Google Lighthouse technology. The Service allows you to:

  • Run performance audits from multiple global regions
  • Schedule automated monitoring
  • Track Core Web Vitals and performance metrics
  • Generate and export performance reports
  • Collaborate with team members

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to use the Service. By registering, you represent that you meet this requirement.

4. Subscription Plans and Billing

Ahoj Metrics offers multiple subscription tiers:

  • Free: 20 audits/month, 30-day retention, no monitors
  • Solo: $35/month, 100 audits/month, 5 monitors, 90-day retention
  • Studio: $69/month, 500 audits/month, 20 monitors, unlimited retention
  • Agency: $299/month, unlimited audits and monitors

Subscriptions automatically renew monthly unless cancelled. You may cancel at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months, except within the 14-day money-back guarantee period.

5. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal purpose
  • Test websites you don't own or have permission to test
  • Attempt to overload or disrupt the Service infrastructure
  • Reverse engineer or attempt to extract source code from the Service
  • Resell or redistribute the Service without authorization
  • Use automated means to create multiple accounts or bypass rate limits
  • Share account credentials with unauthorized users

6. Data and Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided is accurate. Audit results and performance data are stored according to your subscription tier's retention period.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by Ahoj Metrics and protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

8. Service Availability

While we strive for 99.98% uptime, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Ahoj Metrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ahoj Metrics operates, without regard to its conflict of law provisions.
